We take the protection of your personal data seriously and would like you to feel secure when visiting our web pages. The data protection of IPConcept (Luxemburg) S.A. and IPConcept (Switzerland) AG complies with the European Data Protection Directive and, in particular, is based on the Luxembourg law of 02 August 2002 regarding the protection of personal data in data processing in the version of 27 July 2007 (Luxembourg Data Protection Act).

Insofar as you notify us of your personal data, we shall treat these with the due diligence of a bank in accordance with the aforementioned data protection provisions.

Use for other purposes (see Collection and processing of personal data) or forwarding of data to third parties shall not occur. Please note that for technical reasons we are currently not yet able to offer you a secure (encrypted) transmission of your message. For your own security, please send confidential messages to us by post.

Collection and processing of personal data

Generally, you can visit the pages of IPConcept (Luxemburg) S.A. and IPConcept (Switzerland) AG without us requiring personal data from you. We shall only find out the name of your Internet Service Provider, the website from which you are visiting us and the websites that you visit on our server. This information shall be collected and stored by us for statistical purposes in an anonymised format for marketing and optimisation purposes. This data shall be used to create user profiles with a pseudonym. The data shall not be used to personally identify the visitor to this website and shall not be combined with the data on the holder of the pseudonym.

Personal data shall only and exclusively be collected and processed for this purpose if you enter this to order information material.  This information shall partly be transmitted in an encrypted format in order to avoid misuse by third parties.

The use of certain items offered on our web site, such as newsletters, requires prior registration and the further processing of personal data, such as the storage of e-mail addresses for a longer period of time. If you register for a newsletter, such data will be used only for the specified purposes and to the extent necessary to achieve these purposes. Personal data is only forwarded to government institutions and authorities if required by mandatory national laws, or if this is necessary for the prosecution of criminal acts involving attacks on our network infrastructure. The data is not forwarded to third parties for other purposes.

To send out newsletters, we generally use the double opt-in procedure. In other words, after you have registered for the service and provided us with your e-mail address, you click on a link contained in an e-mail you receive from us, to confirm that you wish to receive future newsletters. The objective of this is to assure that only you yourself, as the user of the e-mail address provided, can register for the newsletter service.

You can cancel a newsletter subscription with us at any time. To do this, you can either send us an e-mail or unsubscribe by clicking on a link at the end of the newsletter.

In a few areas of the website, IPConcept (Luxemburg) S.A. and IPConcept (Switzerland) AG use “cookies” so that we can provide you with services that are individually tailored to you. Cookies are identifications that a web server can send to your computer to identify it for the duration of your visit. You can set your browser so that it informs you of any cookies.

Limitations on use and disclosure of personal data

All personal data that is either collected or arises within the scope of IPConcept (Luxemburg) S.A. and IPConcept (Schweiz) AG services will only be collected, processed and used for the purpose of processing contracts, protecting legitimate business interests with regard to the advice and support provided for our customers and potential customers, and the tailoring of products as required in accordance with the respective laws and provisions in force.

Data security

IPConcept (Luxemburg) S.A. and IPConcept (Switzerland) AG  implement technical and organisational security measures in order to protect the data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security measures are continuously improved in accordance with technological developments.

The right to information and the public register of processing operations

On request, we shall notify you in writing and in compliance with the valid laws whether and which personal data we are storing on you.

Based on the LDSG (State Data Protection Act, Article 26 and 28) the data processor must make the following data available in a suitable form to any person:

1. The identity of the data processor:

2. Specific function of data processing:
The data processing is only performed in accordance with Article 4 ff of the LDSG (State Data Protection Act), but in particular for the following reasons:
(a) To fulfil statutory obligations to which the data processor is subject and
(b) To execute a contract to which the person in question is a party, or for the execution of pre-contractual measures that are taken at their request.

3. Recipient or categories of recipients who may be notified of the data:
Public authorities subject to overriding legal stipulations, third parties acting on behalf of the customer or for processing/fulfilling the purposes stated in figure 2.

4. Mandatory periods for storing the data:
Storage duties and terms shall be observed and on expiry the data shall be deleted. If the data are not subject to the aforementioned regulations, they shall be deleted if they can be classed as one of the purposes listed in figure 2.
